1) By that logic, they guy giving out the soup could not in good conscience eat his own dinner.
2) The prerequisite is that "discrimination" is something bad or "evil". The soup guy doesn't like people being "evil" so he discriminates against(?) them.
How is this any better? The soup guy just has a different definition of "evil".
