Ask HN: Can companies use crafty language to alert on data collection?

It appears that some of the surveillance "reform" has included the ability for companies to issue statements such as "0-250 requests for data have been issued." I am curious if there are other ways that companies can alert users of targeted surveillance with crafty language such as "your latency of access has increased"?
