Ask HN: does an auto checkin violate privacy act if the user grants it?

if there is an app that can report its user location automatically in certain time interval without user intervention (auto check-in every X hour or minute), does it violate the privacy act law?

Of course, the user has to acknowledge and grant permission before the app does the auto check in.
